OpenThrottle Terms of Use
Last Updated: May 11, 2026 These Terms of Use ("Terms") govern your access to and use of the OpenThrottle mobile application, website, and related services (collectively, the "Service") operated by Woodside Interactive, LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction (typically 18), you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity (or appropriate parental consent) to enter into these Terms.
2. Account Registration
To use certain features of the Service, you must create an account using a valid email address. You are responsible for: Maintaining the confidentiality of your account credentials All activities that occur under your account Providing accurate and complete information Notifying us immediately of any unauthorized use of your account We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
OpenThrottle is a motorcycle ride tracking and social platform that allows users to: Track and record motorcycle rides using GPS Create and share routes Join and participate in clubs Participate in group rides Join challenges and view leaderboards Share ride data, photos, and content with other users Receive push notifications about activity
4. User Content
4.1 Your Content
You retain ownership of content you submit through the Service, including ride data, photos, routes, posts, and comments ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and providing the Service. This license survives termination of your account with respect to User Content that has already been shared with or incorporated into other users' experiences (for example, group ride records or club feeds).
4.2 Content Standards
You agree not to submit User Content that: Is unlawful, threatening, abusive, harassing, defamatory, or obscene Infringes on any patent, trademark, copyright, or other proprietary rights Contains software viruses or malicious code Is spam, advertising, or unauthorized promotional material Impersonates any person or entity Encourages illegal activity or reckless behavior
4.3 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.
4.4 DMCA / Copyright Complaints
If you believe content on the Service infringes your copyright, please send a written notice to info@woodsideinteractive.com that includes: Your contact information and signature (physical or electronic) Identification of the copyrighted work claimed to be infringed Identification of the material claimed to be infringing and its location within the Service A statement that you have a good-faith belief that the use is not authorized A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner We will respond to valid notices in accordance with the Digital Millennium Copyright Act (DMCA).
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: Use the Service in any way that violates applicable laws or regulations Attempt to gain unauthorized access to the Service or its related systems Interfere with or disrupt the Service or servers connected to the Service Use automated means to access the Service without our express permission Collect or harvest personal information of other users without consent Use the Service to transmit unsolicited communications Reverse engineer, decompile, or disassemble any portion of the Service
6. Clubs and Community Features
6.1 Club Management
Club owners and administrators are responsible for managing their clubs in accordance with these Terms. Club roles (Owner, Admin, Creator, Member) carry specific permissions, and users with elevated roles agree to exercise those permissions responsibly.
6.2 Group Rides
OpenThrottle facilitates the scheduling and coordination of group rides. Participation in group rides is voluntary and at your own risk. Group ride organizers — not Woodside Interactive, LLC — are responsible for planning, leading, and managing any group ride. We do not supervise, direct, or control group rides, and we are not responsible for the conduct of organizers or participants.
6.3 Challenges and Leaderboards
Challenges and leaderboards are community features for tracking riding metrics and friendly competition. Challenge progress is tracked automatically based on recorded ride data. You should never ride unsafely, exceed posted speed limits, or violate traffic laws in pursuit of a challenge, leaderboard position, or any in-app achievement. We reserve the right to remove challenges, reset progress, or disqualify users in cases of abuse, manipulation, or unsafe behavior.
7. Safety Disclaimer
IMPORTANT: OpenThrottle is a ride tracking and social platform, not a navigation or safety device. Do not interact with the application while operating a motorcycle or any vehicle GPS tracking and route features are provided for informational and recreational purposes only You are solely responsible for your safety while riding Always obey traffic laws, wear appropriate safety gear, and ride within your abilities Route suggestions and directions may not account for road conditions, closures, or hazards We are not responsible for any accidents, injuries, or damages that occur during rides
8. Subscriptions and In-App Purchases
Certain features of the Service may require a paid subscription or one-time purchase.
Billing. Subscriptions are billed through the Apple App Store or Google Play Store and managed by our subscription provider, RevenueCat. Payment will be charged to your App Store or Play Store account at confirmation of purchase.
Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless you cancel auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription price.
Managing and Canceling Subscriptions. You can manage and cancel your subscription through your App Store or Google Play account settings. Deleting the OpenThrottle app does not cancel your subscription.
Refunds. Refund requests are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly.
Price Changes. We may change subscription prices from time to time. We will notify you of any price increase in advance and, where required, obtain your consent to continue the subscription.
Free Trials. If a free trial is offered, you will be charged automatically when the trial ends unless you cancel before that time.
9. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Woodside Interactive, LLC and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
10. Third-Party Services
The Service uses and integrates with third-party services, including:
Mapbox — mapping, routing, and map tile services
Google Firebase — authentication, data storage, analytics, and crash reporting
RevenueCat — subscription management
Apple App Store and Google Play Store — app distribution and payment processing We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is governed by their respective terms.
11. Apple App Store Additional Terms
If you access the Service through Apple's App Store, you acknowledge and agree that: These Terms are between you and Woodside Interactive, LLC only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service. Apple is not responsible for addressing any claims you or any third party may have relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Beta and Experimental Features
From time to time, we may offer beta, preview, or experimental features. These features are provided "as is," may contain bugs or errors, may change or be removed at any time, and are not guaranteed to function as intended. Use of beta features is at your own risk.
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe: Violates these Terms Is harmful to other users, us, or third parties Is fraudulent or illegal Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the app settings. Provisions of these Terms that by their nature should survive termination (including User Content licenses already granted, intellectual property rights, disclaimers, limitations of liability, and indemnification) will survive.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: The Service will be uninterrupted, timely, secure, or error-free The results obtained from the Service will be accurate or reliable GPS data, distance calculations, or route information will be precise Any defects in the Service will be corrected
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOODSIDE INTERACTIVE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
16. Indemnification
You agree to indemnify and hold harmless Woodside Interactive, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: Your use of the Service Your User Content Your violation of these Terms Your violation of any rights of another party
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state and federal courts located in Oregon, United States, and you consent to the personal jurisdiction of those courts.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms within the Service and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Woodside Interactive, LLC regarding the Service.
21. Child Safety Policy
We have zero tolerance for child sexual abuse and exploitation (CSAE). Any content or behavior that sexually exploits, abuses, or endangers children is strictly prohibited. This includes grooming, sextortion, trafficking, or sharing child sexual abuse material (CSAM). Violations will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and/or applicable law enforcement authorities. Users can report concerns using the in-app contact feature or by emailing info@woodsideinteractive.com.
